Reasonable steps to confirm consent Daphne Gilbert, a professor of criminal, constitutional and advanced sexual assault law at the University of Ottawa, says it’s possible the judge will find E.M. did not consent, but that some or all of the five accused had an honest mistaken belief that she did. In that defence, the accused must have taken reasonable steps to confirm the complainant’s consent, something the Crown argues the players did not do. “The Supreme Court of Canada has been very clear that the reasonable steps requirement will change depending on the context of the sexual activity,” said Gilbert,…

Alberta’s immigration minister says he’s concerned about the federal government’s plan this year to accept thousands of parents and grandparents of immigrants already in Canada. Joseph Schow responded Tuesday to a federal notice that Ottawa plans to take in 10,000 applications from those who have previously expressed interest in sponsoring family members. Schow took issue with the 10,000 figure. In a statement, Schow said provincial health-care systems, housing and social services don’t have the capacity and could be overwhelmed. Federal Immigration Minister Lena Diab’s office said the federal government’s actual countrywide target for approvals this year for the parent and…

Toronto tennis fans were served up disappointment after the likes of Carlos Alcaraz, Jannik Sinner and other top players dropped out of the National Bank Open this year — a trend experts say could repeat if the tournament structure doesn’t change. The National Bank Open (NBO) expanded from one week to 12-days of competition, with the men facing off in Toronto and the women in Montreal from July 26 to Aug. 7. This year the tournament comes two weeks after Wimbledon and is immediately followed by the Cincinnati Open and the U.S. Open a week after that. The change limits the…

Bright lights. Big opponents. Canadian fans chanting her name. Rebecca Marino remembers every detail of her run at the 2021 National Bank Open. “Having that first match with [American Madison] Keys on centre court, a night match, and I just remember the crowd being so encouraging and really pushing me to win that match,” she said of the first-round victory. “It was just kind of like this electric feeling. I was like, ‘Oh, I want more of that.’ “Those are the things you remember, more like the emotion and that sort of thing, not necessarily the points or like something specific…

There was a remarkably salient moment at a recent journalism conference in Seoul where participants from 50 countries debated climate change and its effect on both the literal and political landscape of the world. The consensus, albeit a rough one, was that the public — from Azerbaijan to Zaire — was exhausted by the issue. It was tough to get their attention and people increasingly tuned out, even though in some cases their homes had literally been blown away. As the matter was debated, the hills outside of the Journalists Association of Korea hall last spring were being ravaged by…

Summer McIntosh has an extremely ambitious goal for the upcoming swimming world championships in Singapore. After winning a Canadian-record three gold medals in four individual events at the Paris Olympics last summer, the 18-year-old phenom now wants to become only the second swimmer in history to win five solo titles at a single long-course world championships. The first was Michael Phelps, who did it in 2007 en route to his iconic eight-gold-medal performance at the Beijing Olympics the following year, which included five individual victories…
